Terms & Conditions

 

Please read our T&Cs with care prior to using the Nina Tans website. By using the website, You signify Your agreement to be bound by these conditions.

 

Definitions

 

Users of the website are referred to as “You” or “Your” and Nina Tans is referred to as “Us” or “We”.

 

1. Security

When You pay using a debit or credit card, Your details are handled by Us on Our SSL Secure payment website.

 

No website is completely impregnable to fraud, but You can be confident with the level of security Our website provides.

 

2.  Order Confirmation

 

When You have placed an order, We will send You a confirmation e-mail with Your order number, reference number and transaction details.

Your order will represent an offer to Us, which is accepted when We process payment for the order. When We have accepted Your order. If You have incorrectly entered your e-mail address, the confirmation e-mail may not reach You regardless of the payment having been processed. Your order will still be dispatched.

 

3. Post

 

Our products are posted within three regions: UK, Europe & Rest of the World. Postage prices will vary by these regions. You can find more information on Our Shipping page.

 

We will only post parcels to valid addresses and postcodes. If You provide incorrect shipping details, We take no responsibility of the order reaching you or any cost involved in placing a new order or redirecting the missing one.

 

We aim to post all parcels within two working days of receiving an order or once a commission has been completed. If Our local Post Office or delivery service is experiencing any disruption, Your order may be dispatched with delay. Due to Our location (Tobermory, Isle of Mull) extreme weather may interrupt the postal service, in which case We may experience longer delays in dispatching orders.

 

 

We do not take responsibility for any damage caused to items in transit, but guarantee all packaging to be designed to prevent any such issues. In case of any damage to your items in transit, please inform us as soon as possible and We will look into the issue and see if the product can be salvaged.

 

4. Contact

 

Our contact details are displayed on the website. We can be reached by telephone Monday-Saturday 10am-4:30pm (GMT/BST). E-mails will be monitored regularly,  and We will get in touch with You as soon as possible.

 

5. Prices

 

Our product prices are presented in GBP and may be updated periodically.

Commission prices vary on a case-by-case basis.

 

6. Products

 

We present product descriptions on our website and these may be updated periodically. If You require any further information on Our products, We will gladly provide You with this information via e-mail or phone.

 

7. Returns & Refunds

​

Paintings can be returned, at Your expense, as an exchange or for a gift voucher. Refunds will not be accepted. 

​

Commissioned works cannot be refunded. Please refer to the Commission Terms & Conditions for more information.

 

8. Cookies

 

Our website uses Cookies and displays a Cookie banner for You to view. You can edit Your cookie preferences on Your browser.

 

Cookies help Us monitor anonymous data gathered from our users. This data will never be released to third parties and will simply be used by Us to monitor the traffic on the site and to improve the websites function. Please get in touch with Us for further information of Our Cookie Policy.

 

9. Privacy

 

We will never disclose any of Your personal details to any third party, unless required by law. We take Your privacy seriously and keep all your information safe on our website. You can request us to delete your information, via e-mail or telephone, and We will comply with Your requests as soon as they are received.

 

10. Mailing List

 

If You wish to be removed from our mailing list, please let Us know and We will immediately remove Your details.

 

11. Your Responsibilities

 

You are responsible for the actions and confidentiality of Your account with Us. Please ensure You keep your details protected as We do not have access or liability over the actions through Your account.

 

12.  Access

 

We aim to keep our website running smoothly at all times but cannot guarantee there will not be disruptions caused by external factors.

 

13. Your Conduct

 

Our website should not be used by You for in any way which will cause it damage or in connection to any unlawful activity.

 

14. Licence for Website Access

 

All our images, products, descriptions and website features are owned by Us and are not for any other party to download, use or copy without Our written consent. The website or any portion of it may not be copied, duplicated, sold, visited, resold or exploited for any commercial or non-commercial reason.

 

15. Copyright

All artwork and content (pictures and text) on the Nina Tans website are the sole property and copyright of Nina Tans and are legally protected by U.K. & international copyright laws.

Under no circumstance may you download, reproduce, publish or distribute elsewhere, in any medium, any of the images for commercial purposes, without proper and prior written permission from Us.

Unauthorised duplication or usage for commercial purposes is prohibited by the Copyright law and will be prosecuted.

Nina Tans retains all of the copyrights to all artwork on this site, regardless of whether or not the original image has been sold. Should you wish to use an image for commercial purposes please contact the Us via e-mail.

16. Credits

​

The Artist’s right to be identified as the author of the Work or Artwork is hereby asserted. The Artist reserves the right to object to or prevent any derogatory treatment of the Work or Artwork in accordance with the provisions of Chapter 4 of the Copyright, Designs and Patents Act 1988 and any prevailing or like legal provisions throughout the world.

 

The Client shall ensure the Artist is credited in any editorial use of the Work. Credits for non- editorial use are not required unless so indicated on the COC or otherwise agreed in writing by the Agency.

 

17. Events Beyond Reasonable Control

 

We will comply with Our obligations under these outlined conditions but take no responsibility of delays caused by events which are beyond our reasonable control. This condition does not affect Your rights.

 

18. Waiver

 

In case of a breach of these conditions by You and no action taken by Us, We will maintain Our rights and remedies in any other situation in which You breach these conditions.

 

18. Governing Law & Jurisdiction

 

These T&Cs will be governed by the courts of Scotland, United Kingdom.
